1. Dictionary (Definitions)
1.1 “User” or “Client” means you, whether an individual or legal entity, who accesses, registers with, or uses Eberths.com (the “Platform”) to search for, submit a Booking Request for, reserve, book, manage, or pay for berths or related marina and mooring services, whether acting as a vessel owner, skipper, charterer, operator, or authorized representative.
1.2 “You” or “Your” means the individual or legal entity that accesses, registers with, or uses Eberths.com, and includes any User and/or Client acting on its own behalf or on behalf of a third party, whether as a vessel owner, skipper, charterer, operator, agent, or authorized representative.
1.3 “Marina” or “Marina Operator” means any individual or legal entity that owns, manages, leases, or controls a marina, harbor, port, mooring field, shipyard, drydock, or other nautical facility and makes berths, moorings, or related services available for reservation through the Platform.
1.4 “Service Provider” means any individual or legal entity that provides marina-related, nautical, or ancillary services through the Platform, including but not limited to berth rental, mooring, docking assistance, fueling, maintenance, electricity, water supply, waste disposal, or security services.
1.5 “Account” means your personal or business profile created on the Platform, through which you may access, manage, and use our services, including searching for availability, reserving, requesting, and paying for berths, buoys, piers, or related marina services via the Platform.
1.6 “Mooring” means the provision by a Marina Operator or Service Provider of a designated space, berth, buoy, pier, or anchoring point for the temporary or permanent securing, docking, or anchoring of a vessel, together with any associated access and basic marina facilities, where applicable.
1.7 “Attraction” means any natural, cultural, recreational, commercial, or tourist point of interest located in or near a marina or within its surrounding area, which may be displayed on the Platform for the information and convenience of Users and Clients. Attractions are provided solely as optional recommendations and are not included in any reservation fee or service package. The inclusion, description, name, or title of any Attraction does not constitute a guarantee, endorsement, or commitment by Eberths.com. Attractions may include, without limitation, tours, museums, landmarks, activities, events, and other local experiences.
1.8 “Booking Request” means the process by which a User requests a berth, buoy, pier, or other designated mooring space within a specific marina, port, harbor, anchorage area, dry dock, shipyard, or similar nautical facility through the Platform, subject to availability and acceptance by the Marina Operator.
1.9 “Booking Confirmation” means the electronic confirmation sent by Eberths.com, by email or other digital means, confirming the acceptance of a Reservation and setting out the essential details, including the marina, dates, boat information, services, pricing, and applicable terms.
1.10 “Payment Method” means any valid and authorized method accepted on the Platform through which Users may pay for a Reservation, including credit cards, debit cards, bank transfers, digital wallets, or other electronic or alternative payment solutions made available from time to time.
1.11 “Terms and Conditions” means these terms of service and all related policies, guidelines, and agreements governing your access to and use of the Platform, as in force and amended from time to time.
1.12 “Third-Party Aggregator” means any individual or legal entity, other than Eberths.com, that collects, lists, promotes, distributes, facilitates, or resells berth reservations, marina services, mooring facilities, or related nautical accommodations through its own website, application, digital marketplace, or other channels, and that acts as an intermediary, agent, or reseller between Users and Marina Operators or Service Providers.
1.13 “Travel Experience” means any travel-related product or service offered through the Platform by a Marina Operator or another authorized Service Provider in connection with a marina stay, including berth reservations, mooring services, on-site facilities, and ancillary marina services.
1.14 “Payment in Advance” means any payment made by Users through the Platform at the time of booking or prior to the commencement of the booked service or marina stay, in order to secure a Reservation.
1.15 “Guarantee” (security deposit) means a monetary amount requested by a Marina Operator from Users, and authorized through the Platform, which may be used to cover potential losses arising from no-show situations, late arrivals, unpaid fees, outstanding balances from your previous stays, or damage caused by You to marina property, facilities, equipment, or third-party assets during your stay.
1.16 “Eberths Commission” means the service fee charged by Eberths.com to Users in connection with a Reservation made through the Platform. The Eberths Commission is added to the applicable marina price and is payable by You at the time of booking or prior to your stay. Unless otherwise expressly stated, all Eberths Commission amounts are calculated and charged in Euros (EUR).
1.17 “Reservation” or “Booking” means a Booking Request that has been accepted by the relevant Marina Operator.
1.18 “Marina Price” means the total amount set and requested by a Marina Operator for the provision of a berth, buoy, pier, or related marina services in connection with a Reservation made through the Platform. The Marina Price is determined solely by the Marina Operator, excluding any Eberths Commission or other fees charged separately by the Platform unless expressly stated otherwise.
1.19 “Amount Payable at the Marina” means the amount due and payable by Users directly to the Marina Operator at the marina office or designated payment point in connection with your stay or use of marina services. This amount is not collected, processed, or paid by Eberths.com and must be settled by You with the Marina Operator prior to departure. You remain solely responsible for the full and timely payment of this amount in accordance with the marina’s applicable rules and policies.
1.20 “Last Minute Request” means a Booking Request made through the Platform within twenty-four (24) hours prior to the intended check-in time or commencement of mooring at a Marina Operator’s facility. Due to the urgency and priority handling required for such requests, Eberths.com may apply a higher commission or service fee.
1.21 “Optional Extras” means any additional or supplementary services, facilities, or amenities requested by a User from a Marina Operator in connection with a Reservation, including bedding, cleaning, water supply, electricity, fuel, waste disposal, internet access, or similar services, which are not included in the standard Marina Price.
1.22 “Check-In Date” and/or “Check-In Time” mean the date and, where applicable, the time at which a User is scheduled to arrive at and commence mooring at a Marina Operator’s facility, in accordance with the preferences selected during the booking process on the Platform. The applicable Check-In Date and Check-In Time are stated in your Booking Confirmation, invoice, and/or voucher.
1.23 “Weather Cancellation” means the cancellation of a confirmed Reservation for a period of one (1) day or less due solely to adverse or unsafe weather conditions that materially affect navigation, access to the marina, or the safe use of mooring facilities.
1.24 “Payout” means a payment initiated and processed through Eberths.com’s authorized third-party payment service provider to a Marina Operator or other approved third-party service provider in connection with services made available through the Platform, including, without limitation, marina service fees, reservation-related charges, and payment processing fees.

“EBERTHS” and/or “EBERTHS.com” refer to the company that owns and operates the internet-based brokerage and reservation platform accessible under the domain www.eberths.com (the “Platform”), through which ports, marina operators, harbor authorities, brokers, berth concessionaires, buoy field providers, pier owners, and other authorized legal or natural persons (collectively, “Marina Operators” or “Marinas”) may list, offer, and manage boat berths, buoys, piers, and related mooring services, and through which boaters, skippers, private vessel owners, charter companies, authorized representatives, and other legal or natural persons (collectively, “Users” and “Clients,” referred to as “You”) may search for, submit Booking Requests for, reserve, and manage such services online.
3. Acceptance and Scope of the Terms
3.1 By accessing, browsing, registering, or using the Platform in any manner, you confirm that you have read these Terms and Conditions, understood them, and agree to be bound by them. If you do not agree, you must stop using the Platform immediately.
3.2 These Terms and Conditions contain important information about your rights and obligations, limitations of liability, and how Booking Requests, Reservations, and payments are handled. You are responsible for reviewing them carefully before using the Platform or submitting any Booking Request.
3.3 These Terms and Conditions, together with (i) your Booking Confirmation (if a Reservation is accepted), (ii) any pre-contractual information provided to you before payment, and (iii) any applicable policies referenced in these Terms, form the contractual framework governing the Platform and the manner in which Marina Operators offer services through it.
3.4 These Terms constitute a legally binding agreement between you and Eberths.com regarding your access to and use of the Platform, including the website and any related subdomains, mobile interfaces, applications, and associated services (together, the “Platform Services”).
3.5 These Terms apply regardless of the communication channel used in connection with the Platform Services, including the website, email, telephone, and messaging applications (including WhatsApp, Viber, and Telegram), where such channels are used for booking-related communication and support.
3.6 The Privacy and Cookie Policy, Cancellation/Modification policies (where applicable), and any other policies expressly referenced on the Platform are incorporated into these Terms by reference and form part of your agreement with Eberths.com.
3.7 Eberths.com provides the Platform as an intermediary and technical marketplace only. Eberths.com does not become a party to any contract for mooring or marina services between you and a Marina Operator. When a Marina Operator accepts a Booking Request, the Reservation and the delivery of on-site services are governed by the direct contractual relationship between you and that Marina Operator.
4. Terminology and Interpretation
4.1 Unless otherwise stated, in these Terms and Conditions, the terms “EBERTHS,” “Eberths.com,” “Site,” “Eberths.com SRL”, “we,” “us,” and “our” refer collectively to the company operating Eberths.com and to the internet-based reservation and brokerage platform accessible at www.eberths.com (the “Platform”).
4.2 The terms “User,” “Client,” “You,” “skipper,” “boater,” “charter company,” “vessel owner,” and “authorized or legal representative of a vessel” are used interchangeably and refer to any individual or legal entity that accesses, registers with, or uses the Platform to search for, submit Booking Requests for, reserve, book, or manage marina and mooring services.
4.3 References in these Terms to “Eberths.com Payments,” “EBERTHS Payment Processor,” or similar expressions mean the third-party payment service provider engaged by Eberths.com to process payments made through the Platform. Eberths.com does not operate its own payment processing system and relies on an independent, authorized third-party legal entity to facilitate secure payment transactions.
4.4 All payments made by Users in connection with Reservations are processed through such third-party payment providers, either directly on the Platform or via a secure payment link sent by Eberths.com. The payment processor acts solely as an intermediary for payment transactions and is responsible for the technical processing of payments in accordance with its own terms and applicable laws.
5. About Eberths.com - intermediary booking platform, marketplace structure, pricing, services and third parties
5.1 Eberths.com refers to the legal entity Eberths.com SRL, with registered office at 37 Macului Street, 077020 Berceni, Ilfov, Romania, registered with the Trade Register under number [to be added].
5.2 When a User or Client (“You”) submits a Booking Request or makes a Reservation through Eberths.com (the “Platform”) with a Marina Operator, Eberths.com provides and operates the Platform and related intermediation services only. Eberths.com is not responsible for, and does not provide, manage, or control, the actual mooring, marina stay, travel, accommodation, or nautical experience, whether occurring in a marina, at sea, on land, in a dry dock, boatyard, anchorage area, or any other location. Such services are provided exclusively by the relevant Marina Operator or third-party service provider.
5.3 Eberths.com may cooperate with independent companies and service providers to support the operation of the Platform and related services, including, without limitation, customer support, technical services, and account management. These third parties: (i) do not own, control, or manage the Platform; (ii) may operate their own independent websites and services; (iii) do not have any direct legal or contractual relationship with Users and Clients (“You”) in connection with Reservations made through the Platform; (iv) may provide separate travel, marina, or mooring-related services in their own name; (v) are not authorized to represent Eberths.com, enter into agreements, or accept legal notices on its behalf; and (vi) do not act as agents, employees, or legal representatives of Eberths.com.
5.4 Eberths.com (the “Platform”) collects and displays information provided by Marina Operators and other Service Providers, including ports, marina operators, brokers, berth concessionaires, buoy field providers, pier owners, and authorized natural or legal persons worldwide. The Platform also integrates data and services from independent third-party providers, including payment processors, weather forecasting services, and communication service providers. While Eberths.com takes reasonable care and exercises professional diligence to ensure that the information made available on the Platform is accurate and up to date, it cannot guarantee the completeness, accuracy, or reliability of all content. Eberths.com shall not be liable for errors, omissions, interruptions, technical failures, or outdated information. However, reasonable efforts will be made to correct any inaccuracies once they become known.
5.5 Eberths.com operates solely as an independent intermediary, agent, and broker facilitating Reservations between Users and Clients (“You”) and Marina Operators. Eberths.com does not own, manage, operate, or control any marina facilities and does not provide mooring, accommodation, or marina services. Eberths.com is not a party to any agreement entered into between You and a Marina Operator. The relevant Marina Operator remains solely responsible for providing the mooring, marina stay, and related services and for ensuring compliance with applicable laws, safety standards, and local regulations.
5.6 In order to submit a Booking Request or make a Reservation, You may be required to create and maintain an Account on the Platform. You are responsible for ensuring that all information provided, including contact and payment details, is accurate, complete, and kept up to date. You are solely responsible for all activity conducted through your Account. You must keep your login credentials, passwords, and payment information strictly confidential and must take all reasonable measures to prevent unauthorized access. Eberths.com shall not be responsible for any loss or damage resulting from unauthorized use of your Account or payment details.
5.7 The Platform is available in multiple languages. Eberths.com may display the Platform in a language selected automatically based on your location or preferences. You may change the language settings at any time through the Platform interface.
5.8 Unless otherwise expressly stated, You must be at least eighteen (18) years of age and have the legal capacity to enter into binding agreements in order to use the Platform.
5.9 Eberths.com operates a digital and technical interface designed to facilitate communication, Booking Requests, and intermediation between Marina Operators and Users. Complementary services (communications via Eberths.com email addresses, telephone support, and messaging applications such as WhatsApp, Viber, and Telegram) form an integral part of the Platform’s service offering and are provided solely to support booking-related interactions.
5.10 In particular, the Platform enables Marina Operators to present and promote their facilities through photographs, descriptions, pricing, capacity information, location details, and nearby attractions, and to publish availability and commercial terms for berths, buoys, piers, and related mooring services.
5.11 The Platform enables Users to search for, submit, and manage Booking Requests with Marina Operators, receive booking-related information and confirmations, and explore alternative Marina Operators and nearby facilities when requested services are unavailable.
5.12 Eberths.com provides these services exclusively as an intermediary and technical platform provider and does not itself operate marinas, provide mooring services, or control the services offered by Marina Operators.
6. Accuracy of content, platform functionality, Marina Operator listings
6.1 Eberths.com does not guarantee the accuracy, completeness, or quality of translations provided on the Platform or in related communications. Certain translations may be generated automatically using third-party translation tools (including AI tools). Such translation services are provided “as is,” and Eberths.com disclaims all warranties relating to their accuracy, reliability, or suitability for any purpose.
6.2 The Platform may contain links to third-party websites, applications, or resources (“Third-Party Services”). Such Third-Party Services are subject to their own terms and privacy policies. Eberths.com does not control, endorse, or assume responsibility for the availability, content, accuracy, products, or services offered by such Third-Party Services.
6.3 The Platform is an online service that depends on networks, hosting infrastructure, and third-party systems. For that reason, continuous or error-free operation cannot be guaranteed. We may temporarily limit, suspend, or disable access to the Platform (in whole or in part) for reasons including maintenance, security, capacity limits, software updates, or technical issues. We may also change, update, or remove features of the Platform at any time.
6.4 Except where expressly permitted by these Terms or authorized in advance in writing by Eberths.com, you must not use the Platform or any part of its content, data, software, booking tools, or technical interfaces for commercial, competitive, or systematic extraction purposes. In particular, you may not:
- copy, reproduce, mirror, or republish Platform content;
- resell, sublicense, or commercially exploit listings, availability data, or pricing information;
- use automated tools, scripts, bots, crawlers, scrapers, or similar technologies to collect or monitor data;
- create derivative databases, datasets, or competing services based on Platform information; or
- interfere with, bypass, or attempt to circumvent technical safeguards implemented on the Platform.
Any unauthorized use of the Platform or its data resources may result in immediate suspension of access and may give rise to legal action.
6.5 If a Marina Operator’s facilities, services, or conditions do not correspond to the information displayed on its listing page on the Platform, Users are encouraged to notify Eberths.com and provide reasonable supporting evidence before submitting a Booking Request.
6.6 If, after becoming aware of alleged inaccuracies or potentially misleading information, You choose to proceed with a Booking Request or Reservation, You acknowledge that Eberths.com relies on information provided by Marina Operators and that any remedy relating to the marina’s on-site services should be pursued primarily with the Marina Operator. This does not affect any rights You may have under applicable law.
6.7 Eberths.com acts solely as an intermediary and relies on information provided by Marina Operators. Accordingly, Eberths.com does not warrant the accuracy, completeness, or reliability of marina listings and shall not be liable for any errors, omissions, or misrepresentations contained therein, except as required by applicable law.
7. Platform Use, Registration, and User Responsibilities
7.1 Eberths.com (the “Platform”) provides comprehensive and up-to-date information about Marina Operators and their facilities, enabling Users and Clients (“You”) to search for, compare, and book berths, buoys, and piers in accordance with your travel plans, vessel specifications, and personal preferences.
7.2 Access to and use of the Platform for searching and viewing available services is provided free of charge to Users and Clients (“You”). Applicable fees and commissions are charged only in connection with confirmed Reservations, in accordance with these Terms.
7.3 You may create and maintain a personal Account on the Platform (“User Account”). By registering an Account, You agree to provide accurate, complete, and up-to-date personal and boat-related information and acknowledge that your registration constitutes acceptance of these Terms and Conditions.
7.4 If You choose not to create an Account, any Booking Request, Reservation, or payment made through the Platform constitutes your express acceptance of these Terms and Conditions. No Booking Request or payment may be completed without such acceptance.
7.5 By creating an Account on Eberths.com (the “Platform”), Users and Clients (“You”) confirm that You are at least eighteen (18) years of age and have the legal capacity to enter into binding agreements. Individuals under the age of eighteen (18) are not permitted to access or use the Platform without the prior verifiable consent of a parent or legal guardian. Eberths.com reserves the right to request proof of age or such consent and may suspend or terminate any Account found to be in violation of this requirement.
7.6 You are solely responsible for providing accurate and complete information relating to your boat and your intended stay, including, without limitation, the vessel name, dimensions (length, width, and draught), Check-In and Check-Out Dates, and the selected Marina Operator. You further warrant that your vessel complies with all applicable safety, seaworthiness, and regulatory standards.
7.7 You are responsible for providing accurate, complete, and up-to-date contact information, including your name, email address, telephone number, and any other required details, to enable Eberths.com and/or the relevant Marina Operator to communicate with You regarding your Booking Request, Reservation, or Account and, where necessary, to contact You in connection with your use of the Platform.
7.8 Marina Operators reserve the right to verify the information provided by You and to accept or reject any Booking Request based on such verification.
7.9 A Marina Operator may cancel or refuse a confirmed or paid Reservation if the information provided by You is inaccurate, incomplete, or misleading, including, without limitation, discrepancies relating to vessel dimensions or specifications. A Marina Operator may also refuse or cancel a Reservation based on your prior history with the marina, including previous payment defaults, property damage, or violations of marina rules and policies.
7.10 You are financially responsible for all transactions, payments, and activities carried out through your Account or in your name.
7.11 You agree not to use the Platform for speculative, misleading, fraudulent, or unauthorized reservation activity.
7.12 You agree not to copy, modify, distribute, transmit, sell, license, publish, or exploit any content, software, or materials available on the Platform, except for limited personal and non-commercial use in accordance with these Terms.
7.13 You agree to read, understand, and comply with these Terms and Conditions, as well as the applicable terms, rules, and policies of Marina Operators and, where relevant, Third-Party Aggregators or Service Providers. You acknowledge that any breach of such terms may result in additional charges, penalties, suspension of services, and/or the cancellation of your Reservation.
8. Account Management and Security
8.1 Users and Clients (“You”) are responsible for keeping the information contained in your Account accurate, complete, and up to date. You must notify Eberths.com and update your Account details, including vessel information and contact details (such as vessel name, flag, and address), in the event of any changes and, where applicable, no later than fourteen (14) days prior to your scheduled Check-In Date. Eberths.com shall not be liable for any loss, damage, or disruption resulting from your failure to update such information.
8.2 You are responsible for maintaining the confidentiality of your Account login credentials, including your username and password, and for preventing unauthorized access to your Account. You must not disclose your login details to any third party.
8.3 You agree to notify Eberths.com immediately of any actual or suspected unauthorized access, misuse, or security breach relating to your Account. Until Eberths.com receives such notification, all actions, transactions, and communications carried out through your Account shall be deemed to have been authorized by You and shall remain your sole responsibility.
8.4 In the event that You engage in unlawful conduct, misuse the Platform, or breach these Terms and Conditions, Eberths.com reserves the right, at its sole discretion, to suspend, restrict, or permanently terminate your Account, without prejudice to any other rights or remedies available under applicable law.
8.5 You may request the deletion of your Account at any time by contacting Eberths.com in writing via email. Account deletion may be subject to legal, regulatory, or contractual retention requirements.
8.6 If You forget your login credentials or become aware of improper use of your Account by third parties, You must promptly inform Eberths.com Customer Support by sending an email to albert@eberths.com.
9. Booking Request Process
9.1 Users and Clients (“You”) may submit a Booking Request through the Platform by selecting a Marina Operator of your choice and completing the required information on the relevant marina page, including vessel details, preferred Check-In and Check-Out Dates, and accurate contact information.
9.2 After providing all required information, You may submit your Booking Request by selecting the “Reserve” option. Prior to submission, You must review and accept these Terms and Conditions. You may review, modify, or delete your entries at any time before submission or cancel the process by closing your browser or using the back function.
9.3 Upon receipt of your Booking Request, Eberths.com will forward the request to the relevant Marina Operator and, subject to availability, will use reasonable efforts to confirm berth availability and pricing, generally within forty-eight (48) hours. Last Minute Requests may be processed on an expedited basis. Submission of a Booking Request does not, in itself, create a binding contract between You and the Marina Operator.
9.4 By submitting a Booking Request, You confirm that all information provided is accurate, complete, and up to date.
9.5 Each Marina Operator independently reviews and determines whether to accept or reject a Booking Request based on vessel specifications, requested dates, operational capacity, and applicable marina policies.
9.6 If a Marina Operator accepts your Booking Request, Eberths.com will send You a Booking Confirmation by email setting out the essential terms of the accepted Reservation, including the Marina Price, payment conditions, and any applicable guarantees or deposits.
9.7 Where a Payment in Advance is required, such payment may consist of one or more of the following components: the advance payment requested by the Marina Operator for the reservation; the applicable Eberths.com Commission; and any required Guarantee. These amounts must be paid and accepted by You in accordance with the instructions provided in the Booking Confirmation.
9.8 The Booking Confirmation will also specify any remaining balance payable by You directly to the Marina Operator upon arrival or before departure, together with any additional charges that may arise during your stay.
9.9 You agree to pay directly to the Marina Operator, at the marina office or designated payment location, any amounts indicated as payable on arrival or during your stay. You remain solely and legally responsible for the full and timely payment of such amounts.
9.10 Eberths.com does not collect, process, or assume responsibility for payments required to be made directly to Marina Operators and shall not be liable for any disputes, adjustments, or additional charges imposed by a Marina Operator in accordance with its policies and applicable law.
9.11 Local taxes and charges required by the Marina Operator or local authorities are not included in the price offer you receive from Eberths.com. Such taxes and charges (tourism taxes, stay-in-port taxes, city/municipality/resort taxes, environmental/pollution charges, etc.) must be paid directly by You to the Marina Operator.
9.12 Certain Marina Operators may offer the option to submit a Booking Request through an API integration with Eberths.com instead of, or in addition to, a Booking Request. Each Marina Operator independently determines whether to accept or reject any Booking Request submitted through the Platform.
9.13 By selecting the “Book Your Berth Now (Advance Payment)” option, you authorize the Payment Service Provider to process an immediate and final charge to your selected Payment Method for the full amount of the Payment in Advance, which may include, as applicable: the advance payment requested by the Marina Operator; any required Guarantee; and the applicable Eberths.com Commission (collectively, the “Reservation Fee”).
9.14 Upon arrival at the marina, You agree to pay directly to the Marina Operator, at the marina office or designated payment location, any remaining balance or difference relating to your Reservation. This amount must be settled by You prior to leaving the port, in accordance with the Marina Operator’s payment conditions.
9.15 Any such balance payable at the marina is your sole responsibility and is not collected, managed, or guaranteed by Eberths.com. Eberths.com shall not be liable for any failure by You to settle outstanding amounts with the Marina Operator. The Marina Operator may invoice You directly for such amounts in accordance with its internal procedures and applicable law.
10. Payment and Transactions
10.1 Prices displayed on the Platform or through official Eberths.com email addresses (including, without limitation, albert@eberths.com), and through Eberths.com telephone or messaging services (including WhatsApp, Viber, and Telegram), are shown in EUR and include VAT (if applicable) unless stated otherwise. Prices exclude local taxes and charges payable at the marina or to local authorities (e.g., tourist/port/city/environmental taxes), unless expressly stated as included.
10.2 All payment transactions made through the Platform are processed by an authorized third-party payment service provider selected by Eberths.com (the “Payment Service Provider”). Eberths.com does not store, process, or have access to Users’ and Clients’ (“You”) sensitive payment information, including, without limitation, credit card details, bank information, or digital wallet credentials.
10.3 The Payment Service Provider is solely responsible for determining and administering the forms of payment it accepts, including, without limitation, the types of credit cards, debit cards, digital wallets, currencies, issuing banks, user eligibility, and country or citizenship restrictions, in accordance with applicable international laws, regulations, and internal compliance policies. Eberths.com has no control over, and assumes no legal responsibility for, any refusal, limitation, suspension, or restriction imposed by the Payment Service Provider in relation to payment methods or user eligibility.
10.4 When you select a payment option on the Platform, you instruct and authorize the Payment Service Provider to charge the selected Payment Method for the amount shown to you at checkout (including any applicable Eberths Commission and any required Guarantee, where indicated).
10.5 Once the transaction is completed, you will receive a confirmation through the Platform and/or by electronic message. The timing of settlement, authorization holds, charge confirmations, or reversals depends on the Payment Service Provider and your issuing bank or payment institution.
10.6 Payment processing is carried out by the Payment Service Provider under its own technical and compliance rules. To the extent permitted by law, Eberths.com is not responsible for payment delays, authentication failures, rejected payments, bank or network outages, security checks, risk controls, or other payment-system restrictions that may prevent or delay completion of a transaction, except where such issue results directly from Eberths.com’s systems.
11. Cancellation, Modification, and No-Show Policies
11.1 Users and Clients (“You”) are responsible for requesting and managing any modifications or cancellations of a Booking Request or Reservation made through the Platform, whether through your Account, by email, by telephone, or via authorized messaging applications (including WhatsApp, Viber, and Telegram).
11.2 Any modification or cancellation of a confirmed Reservation is subject to these Terms and the applicable cancellation and modification policy of the relevant Marina Operator. Such policies are displayed on the marina’s information page on the Platform and are incorporated into these Terms by reference.
11.3 You acknowledge that modifications or cancellations may result in additional charges, penalties, or the loss of amounts already paid, depending on the applicable Marina Operator’s policy.
11.4 Cancellation, modification, and no-show policies are determined individually by each Marina Operator and may vary between marina operators. Some Marina Operators apply restrictive policies that do not permit refunds, while others may allow partial or full refunds under specific conditions. You are solely responsible for reviewing and understanding the applicable policy prior to submitting a Booking Request or making any payment.
11.5 By submitting a Booking Request and/or making any Payment in Advance through the Platform, You expressly accept the cancellation and modification policy of the relevant Marina Operator.
11.6 The applicable policy is made available on the Platform, on the marina’s presentation page, and in booking-related communications and payment instructions sent by Eberths.com. Unless required otherwise by applicable law or unless the cancellation is due to Eberths.com’s fault, the Eberths Commission is non-refundable once a Reservation is confirmed.
11.7 For any modification of a confirmed Reservation, Eberths.com may charge an additional commission or service fee. Where a Marina Operator imposes additional charges in connection with a modification, Eberths.com will pass such charges on to You in accordance with the Marina Operator’s requirements.
11.8 Depending on the cancellation policy established by the relevant Marina Operator, the conditions applicable to a Booking Request or Reservation may include, without limitation, one of the following:
11.8(a) Free Cancellation Policy: You may be entitled to a refund of up to one hundred percent (100%) of the amounts paid, excluding the applicable Eberths.com Commission, provided that the cancellation is made within the timeframe specified by the Marina Operator. Where permitted, any unused portion of your stay after check-in may be refunded in accordance with the Marina Operator’s applicable rules and procedures.
11.8(b) Moderate Cancellation Policy: If You cancel within the period specified by the Marina Operator prior to the Check-In Date (which may typically be up to forty-five (45) days before arrival), You may be entitled to a partial refund, generally up to fifty percent (50%) of the price requested by the marina to be paid in advance, subject to the applicable policy and conditions. The Eberths Commission is not refundable unless required by applicable law.
11.8(c) Restrictive Cancellation Policy: If You cancel within the period specified by the Marina Operator prior to the Check-In Date (which may typically be within forty-five (45) days before arrival), You may not be entitled to any refund. The Eberths Commission is not refundable unless required by applicable law.
11.9 The specific cancellation policy applicable to your Reservation shall be determined solely by the relevant Marina Operator and shall be indicated on the marina’s information page and in your Booking Confirmation.
11.10 The specific policy applicable to your Reservation is determined solely by the relevant Marina Operator and shall prevail over any general examples provided in these Terms.
11.11 In the event that any remaining amounts due in connection with a Reservation cannot be successfully authorized, captured, or collected by the Payment Service Provider, the Marina Operator reserves the right to cancel the Reservation without prior notice or formal warning.
12. Payment Methods, Payout Methods, Refunds, and Credit Invoices
12.1 The Payment Methods and Payout Methods available on the Platform, as well as the methods used for processing refunds and issuing credit invoices, are determined and provided exclusively by the authorized third-party Payment Service Provider.
12.2 Users and Clients (“You”) are solely responsible for ensuring that all Payment Method, Payout Method, and billing information submitted through the Platform is accurate, complete, and up to date. Eberths.com does not verify such information and shall not be liable for any loss, delay, failed transaction, misdirected payment, incorrect refund, or improperly issued credit invoice resulting from inaccurate, incomplete, or outdated details provided by You.
12.3 Where a refund is approved, it shall be processed based on the payment and identification information provided by You, including, without limitation, the name of the individual or legal entity, bank account details (such as IBAN), bank name, and any other information reasonably required for processing the refund. Such information may be requested by Eberths.com by email or through other authorized communication channels.
12.4 You acknowledge and agree that any delay, error, or failure in processing a refund resulting from incomplete, incorrect, or inconsistent information provided by You shall be your sole responsibility.
12.5 All refunds and credit invoices are processed in accordance with the policies of the relevant Marina Operator, the applicable Payment Service Provider, and these Terms and Conditions. Eberths.com acts solely as an intermediary in such processes and does not guarantee the timing, method, or successful completion of any refund or credit transaction, except as required by applicable law.
13. Liability Disclaimer and Limitation of Responsibility
13.1 General Disclaimer. Eberths.com provides its services as a technical and intermediary platform facilitating bookings between Users and Marina Operators. Your ability to access and use the Platform depends on your own technical skills, equipment, and internet connection. Eberths.com shall not be responsible for any loss or inconvenience resulting from insufficient technical capability or improper use of the Platform.
13.2 “As-Is / As-Available” Operation. The Platform and the Platform Services are provided on an “as is” and “as available” basis and depend on the availability and performance of networks, hosting infrastructure, third-party systems, data feeds, and service providers. While Eberths.com uses reasonable efforts to maintain the reliability and functionality of the Platform, we do not guarantee continuous, uninterrupted, or error-free operation, or compatibility with all devices, browsers, networks, software environments, or configurations. The operation of the Platform may be affected by maintenance, upgrades, security incidents, system limitations, or failures of third-party services or integrations.
To the maximum extent permitted by applicable law, Eberths disclaims all warranties, whether express, implied, or statutory, in relation to the availability, accuracy, reliability, and performance of the Platform and the Platform Services.
Information displayed on the Platform, including marina listings, availability, pricing, and other third-party content, is supplied through Marina Operators and external data sources and may be updated, modified, delayed, or withdrawn from time to time.
13.3 Limitation of liability. Eberths.com’s role is limited to providing a technical marketplace that enables Users to submit Booking Requests and, where accepted, conclude Reservations directly with Marina Operators. The marina stay and any on-site services are performed solely by the Marina Operator. To the fullest extent permitted by law, Eberths.com is not liable for indirect or consequential losses (including loss of profit, loss of opportunity, loss of goodwill, loss of data, or costs of alternative mooring). If, despite the above, Eberths.com is held liable for a matter arising out of a specific Reservation, Eberths.com’s total aggregate liability for that Reservation is limited to the amount of Eberths Commission actually received by Eberths.com for that Reservation. Nothing in these Terms limits liability where such limitation is prohibited by mandatory law.
13.4 Marina Operator and Third-Party Responsibility. Eberths.com acts solely as an intermediary and is not responsible for the acts, omissions, performance, safety standards, service quality, or legal compliance of Marina Operators or other third-party service providers. Any claims arising from your stay, mooring, or marina services must be addressed directly to the relevant Marina Operator.
13.5 Tax Responsibility. Eberths.com is not responsible for the calculation, collection, withholding, declaration, or payment of any taxes, duties, or governmental charges applicable to Marina Prices or related services, unless expressly required by applicable law.
14. User-Generated Content and Image Rights
14.1 If you submit, upload, or publish photographs, images, text, reviews, videos, or other materials through the Platform (“User Content”), you represent and warrant that you own the relevant rights or have obtained all necessary permissions to use and share such content and that its publication does not infringe any intellectual property, privacy, or other legal rights of any third party.
By making User Content available on the Platform, you grant Eberths.com a non-exclusive, sublicensable solely to technical and operational service providers, worldwide, royalty-free right and licence to store, host, reproduce, adapt, display, publish, and communicate such User Content solely for the purposes of operating, maintaining, promoting, developing, and improving the Platform and its related services, including its presentation in marina listings, search results, and marketing materials.
You may request the removal of your User Content at any time by contacting Eberths.com. Where technically feasible and legally permissible, we will take reasonable steps to remove or anonymize such content, subject to applicable legal, regulatory, or record-retention obligations.
14.2 You agree that uploaded content shall not contain unlawful, offensive, defamatory, misleading, obscene, or inappropriate material, nor malware or harmful code. Eberths.com reserves the right, but not the obligation, to review, remove, modify, or restrict access to any content at its sole discretion, without prior notice. You remain solely responsible for all content submitted through your Account.
15. Right of Withdrawal
15.1 In accordance with applicable consumer protection laws, Users and Clients (“You”) who qualify as consumers may have the right to withdraw from the agreement governing the use of the Platform within the period prescribed by applicable law, without giving any reason, subject to any statutory conditions or exceptions.
15.2 The withdrawal period begins on the day your Account is created. To exercise this right, You must notify Eberths.com of your decision to withdraw by means of a clear written statement sent by email, online form, or other appropriate communication method. The use of any specific withdrawal form is optional.
15.3 The right of withdrawal applies solely to your contractual relationship with Eberths.com regarding the use of the Platform. It does not automatically apply to Reservations made with Marina Operators.
15.4 For Reservations made through the Platform, the applicable cancellation and refund rules are governed exclusively by the relevant Marina Operator’s cancellation policy, as described in Section 11. Where required by law, the Marina Operator will inform You separately of any applicable withdrawal rights.
16. Data Protection and Cookie Privacy Policy
Information regarding the collection, processing, storage, and use of personal data in connection with your use of the Platform is set out in Eberths.com’s Privacy and Cookie Policy, which is available on the Platform and forms an integral part of these Terms.
17. Intellectual Property and Copyright
17.1 Ownership of Content. All content made available on Eberths.com (the “Platform”), including but not limited to text, images, photographs, videos, logos, graphics, databases, software, design elements, technical interfaces, and documentation (the “Content”), is protected by Romanian Law no. 8/1996 on copyright and related rights, applicable European Union legislation, and international intellectual property conventions. Such Content is owned by, or lawfully licensed to, Eberths.com and/or the relevant Marina Operators or third parties who have provided such Content for publication on the Platform. The selection, structure, and arrangement of Content on the Platform may constitute a protected database or database work under Romanian and European Union law.
17.2 Protection of Brands and Slogans. The names, trademarks, trade names, logos, and commercial identifiers, including Eberths, Eberths.com, By Albert de Craiciu, All berths, One Thalassa, Allberths, One Thalassa, are the exclusive property of Eberths and are protected as copyrighted works, trademarks, and/or commercial identifiers under Romanian and European Union law. Any unauthorized use, reproduction, imitation, adaptation, or commercial exploitation of these elements is strictly prohibited and may give rise to civil and criminal liability.
17.3 Use of the Platform and Content. Use of the Platform and Content is subject to the restrictions in Section 6.4. Unauthorized extraction, reuse, or commercialization of Platform data or Content may infringe intellectual property rights and database protections under applicable law.
18. Force Majeure
18.1 Neither Eberths.com nor any Marina Operator is responsible for a delay or failure to perform obligations to the extent that it is caused by events outside reasonable control, including severe weather, port closures, natural disasters, armed conflict, civil unrest, government measures, pandemics/epidemics, major failures of internet/telecommunications infrastructure, or disruptions affecting critical third-party providers (including payment processing).
18.2 If a Force Majeure Event affects Platform operations, safety, or the ability to process Booking Requests or Reservations, Eberths.com may take proportionate measures such as temporarily restricting Platform functions, delaying communications, or suspending certain services, where necessary to protect users, vessels, infrastructure, and legal compliance.
18.3 Where reasonably possible, Eberths.com will inform affected Users about the Force Majeure Event and its expected operational impact. Any payment obligations that arose before the Force Majeure Event remain payable unless mandatory law requires otherwise. Refunds, cancellations, or changes caused by a Force Majeure Event remain subject to the Marina Operator’s applicable cancellation policy and any mandatory consumer rules.
19. Governing Law and Jurisdiction
19.1 These Terms and Conditions, their interpretation, performance, and enforcement, as well as any dispute, claim, or controversy arising out of or in connection with the use of the Platform, shall be governed exclusively by the laws of Romania. Unless otherwise required by mandatory consumer protection laws, the competent courts of Romania shall have exclusive jurisdiction over any disputes arising under or in connection with these Terms.

20.2 Required information. To help us respond efficiently, please include (where applicable): your full name, the email address used on the Platform, your phone number, vessel name, the relevant marina, and your Booking/Reservation reference number.
20.3 Response times. We aim to respond within a reasonable time during normal business hours. Response times may be longer during peak seasons, weekends, public holidays, or in urgent last-minute situations.
20.4 Urgent matters. For time-critical matters (for example, same-day arrival, last-minute changes, access issues at check-in, or safety-related concerns), you should also contact the relevant Marina Operator directly using the contact details shown in the marina listing or your Booking Confirmation. Eberths.com acts as an intermediary and cannot control marina operations or emergency response.
20.5 Notices and legal communications. Formal legal notices intended for Eberths.com must be sent in writing to the email address and/or postal address above and must include sufficient details to identify the User and any relevant Booking. Messages sent via social media, third-party messaging applications, or informal channels do not constitute formal legal notice unless we expressly confirm acceptance in writing.
21. Prevailing Language; Interpretation
The English version of this Terms and Conditions issued by Eberths.com is the official and legally controlling version. Any translated versions are provided solely for informational and convenience purposes. In the event that any question arises regarding the interpretation, validity, enforceability, or meaning of any provision of this Policy, the English version shall govern and prevail in all respects.
